I was scammed by a roofer and do not have the money to replace it. What is my financial responsibility to the insurance company?Also I am listing my house soon. Do I have to disclose this information?

First its not a good idea to piggyback your question on another thread. This can lead to confusion. So I've moved your question to its own thread.
What do you mean by scammed? Why would the insurance company be involved? And yes, you have to disclose any defect you are aware of.

Thank you. What I mean is, we filed a claim with the insurance co. and gave the scammer roof guy the check. He left with the dough and we haven't replaced the roof. We've filed criminal charges with the DA. We will not try to sell the house saying we have a new roof but, just wondering... what my responsibility is to the insurance co.

Homeowner's insurance? If the insurance company paid you for damage to your roof, you have no responsibility to them.
But if it's insurance which your lender required you to carry, and the lender is named as a co-insured, you would be responsible to the lender. I'd guess that this isn't the case: the lender would have had to endorse the check, and probably wouldn't have been as clueless as you were, in paying the money over to the roofer before the work was done.

The insurance company paid you for the claim, they will not pay you again, it is you responsiblty to pay for the new roof.
You are just out the money.

The lender was required to cosign the check, I was the one clueless. Now, how will the lender know that there is not a new roof? Or do I let them know ? Thanks again so much for all your input.

Did you file a police report on the scam. Send the lender a copy of the police report.

Thank you all again. I am going to disclose to the Realtor that I was scammed and let the chips fall where they may. Sending a copy of the DA's report is a great suggestion and I feel more at ease already.
