View Full Version : How to remove a conviction from your record

I had felony forgery convictions in two different counties. In the first county I had 3 felony forgery convictions in 3 different cases. About 2 years ago my public defender ask for a 402 reduction in each of the cases. My criminal record does not show any forgery convictions any more. It's like they removed them completely. In the 2nd county I had 2 cases, each one with 1 felony forgery conviction. I submitted a 402 reduction and the judge ordered the reduction to a Class A Misdemeanor but it still shows forgery. I read the code again, and they did exactly what I asked of them. What, if anything, can I do, to get the forgery removed my record? Can I write a letter to the judge explaining what happened in the first county, and asking her to do the same. I have talked to the judge's clerk, the Legal Defenders and the law library and they all tell me there is nothing more I can do. But if the 1st county was able to remove my felony forgery from my records, there's got to be something I can do to get the 2nd county to do the same. I just don't know what. When you have a crime against person's no one will hire you. I have checked into expuging my record, but I don't qualify because I also had 3 Misdemeanors in the 1st county and now I have 2 Misdemeanors in the 2nd county. In Utah if you have 5 or more convictions in separate cases, you do not qualify. Please someone help me. I am ready to move forward with my life, and I am still unable to. When I talked to the judge's clerk, I asked if I could get a court date to talk with her about my situation and she told me no.

I don't think there's anything you can do - you checked and it can't be expunged, a letter to the Judge will get you nowhere, the Clerk doesn't want to get involved.

You could always consult with a good criminal Attorney but I don't think you can.

The judge in the 2nd county probably thinks the judge in the 1st county isn't doing things right. Nothing says that everyone has to do things just like everyone else does them.

I faxed all my case info from the county that removed my felonies and my criminal history report to a really good criminal attorney. The reason I feel the second county should do the same as the first is because when the 2nd county sentenced me, they also said they would let the 1st county deal with me. I just want to move on with my life and with this over my head, it is impossible. Thanks for your input.
