ANY question on law needs to include your general locale as laws vary by area.
Most areas require that a couple be married before allowing a step parent adoption, but not all. Since I would not recommend doping an adoption without an attorney, shop around for an local Family Law attorney who will details the requirements and steps.

First it is great that there is someone willing to be the father.
I am confused of the dates, boy is 9 you have been with boyfriend for 10 years, so you cheated on him and got pregnant ? Or did you get with him right after getting pregnant ?
Also where is the bio dad, have you filed for custody though the courts, do you have a order of child support against the bio dad ? Does he ever contact the child.
It goes much easier on the adoption if the bio dad will sign over for it to happen. will he do that ?
And why does he "keep asking" if you are giving him the truth, he has another dad and has his name, a 9 year old should understand that.

I missed this part. At 9 he is old enough to understand and it should be explained to him. You don't say what happened between you and the father, but you need to explain to him that you made a mistake that turned out real way because he was the result. And that you are going to try to correct that mistake through step parent adoption.
