I don't have an answer but a question. My son is saying on a daily basis to us that he has so many visions in his head that my husband abused him that it has to be true. It is not. My daughter who was there has told him repeatedly that this is not true. We were not a family that didn't have aunts, uncles, nieces, grandparents, etc. involved with us all the time. After he grew up, he didn't want to work and we found out that he was saying all these things, we believe to make people feel sorry for him. He has tried to make people feel sorry for him with this story so long now, that I believe he thinks this is true. My son doesn't like to work so every time he is homeless, we take him back in. This is often. He has been with us for two years now. He left and didn't speak to us for five years because we cut off his rent and utility payments that we had been paying for three years for him, his girlfriend, and two children. Then she found someone and he was homeless and called us and here he is for two years now. I need help because I believe that he wants our house and what little money we have without us and I believe that he will kill us to get it. In 2000, just after he met the mother of his children, he tried to choke my husband to death. My husband has very long arms and is 6 feet. My son is 5'6" and my husband could easily have hurt him but never raised a hand to my son. The police were called and he Bakers Aced himself. I believe he did this because after he told the police that my husband had attacked him and they found all the marks on my husband that he was afraid that they would arrest him. I have been told that my son has bi-polar and other things. I need to get him out of my house but I need to get him committed because he is always trying to find women on the internet and never uses protection, doesn't know what is real, and cannot take care of himself, and I feel that he is a danger to himself and us. If you could read his text to my daughter, you would understand the problem. I am in Florida and would appreciate anything anyone can tell me.

Do you mean that he had a psychiatric evaluation at that time pursuant to the Baker Act?

If so, he should have received the results in writing and that would have included a recommended treatment plan which apparently didn't include holding beyond the 72 hour limit imposed by law. The information in that assessment, and it must be part of the permanent medical record, could greatly influence future attempts to have the patient committed against his will to either in-patient or out-patient care.

Florida law does have a provision that allows for court ordered out-patient treatment and the requirements are contained here:
