My son is 21, has autism and is supposed to receive 400.00 a month in child support from his father for the rest of his life. His father retired last year and my son who was receiving SSI now receives SS under his fathers social security. My ex husband has decided that because our son now receives more money in his social secuity because my ex husband has retired, he is now only going to pay 200.00 a month. My question is, is this legal, will the courts rule in my favor, is it worth pursueing in court. Any advice would be appreciated.

He cannot change how much he pays without going back to court and change the court order.

Support may be based on income and ability to pay. So the court may?
1. increase it from 400 if that is low according to his current income
2. decrease it from 400 if it is not correct with the way it is figured in your state.
3. leave it the same.

Thanks Chuck... I guess I will mention court to him... I really don't have the money to go back to court...
