In California, I legally changed my 5 year-old son's last name to my maiden last name when he was only 8 months old at a custody hearing. I was also granted full sole-legal and physical custody. The father pays child support but has not met his son. I married 3 years ago and adopted my husbands last name. My husband changed my sons diapers while he was a baby and recognizes him as his child. I now live in Texas. Since my son has my maiden name, do I still need permission from the father if I have sole legal and physical custody?
