Privacy act law
I have a company that is threatening to sue me for a payday loan I do not recall. When they called the first time I was not home and my fiancé answered who has no ties to my finances what so ever and they told her who they were and that I was being sued for a sum amount, and they ran a credit check witch I'm on fraud alert for id theft they just told her all the information they have on me. I have talked to collectors in the past and they tell me they can't discuss anything with anyone other than the person who owes the debt. When talked to them they told me they called the bank that I used to deal with and told me that they talked to some one and got deposit and with drawl transaction information with out my verbal consent and no court order to be able to receive any account information the company is a real company but I do not recall this payday loan and they refuse to send me proof by certified U.S. mail. One person said they would send it e-mail I refused it I wanted it to be postal and then some one else said they don't send e-mails or postal.
So as far as them giving the information to some one who is not linked to this loan or my checking account would this violate my privacy rites? Please let me know
