My husband and I are separated and have a one year old daughter what rights does he have to access over night rights to our daughter?

He is the father, he has the SAME rights as you. Unless a court has issued a custody/visitation order, you are equal in the eyes of the law. The only thing is possession is 9/10ths of the law. But if you refuse him reasonable visitation, when he goes to court, the court may not look as kindly on him.

Agree, unless you have went to court and got any type of custody, agreement he has the same rights as you, to keep the child in his home

If he wants over night visits, even longer all he has to do is file for either joint custody or visits in court. He could most likely even get 50/50 time with her, you have the child one week, he has child one week.

But he will get almost for sure, every other weekend and a night during the week.
