My mother has been living in a gated community for almost a year now, and her lease is up in 4 months. For the past 8 months, the gate to get into the community has been continuously broken. For the past month that I've been living here it has not once been closed, and I know that this was the case for a while before I got here. This obviously is a security issue and Las Vegas has some very unsavory characters. This company has many other properties, and all of them are advertised as being gated. Since this issue has been going on for such a long time with no fix, does she have legal ground to break her lease?

How they advertise does not matter, is "gated" named in the lease, does the lease promise her that the gate will work.
Has the there been additional crime ( or crime at all) in the neighbor since gate is not working.
The thing with breaking the lease, even if it sounds like a good reason, you will not be sure till you actually break it. When they take you to court for the money, you then use these as your defense it will be up to the judge.

Within the first month of the gate not working, my brothers bike was stolen off our porch, which we reported to the property manager. I have to go home and look through the lease regarding the gate, but our complex is behind a Walmart, the goodwill and a small casino/bar so there are always peddlers around and no control over who walks into the community.
