Can a debitor garnish my ssi/ssd and child support?help me!!

Social Security does not allow garnishment of disability benefits by creditors. Any credit card company, business, or individual who has won a judgment against you will never garnish your Social Security disability check.

Social Security will allow garnishment of your Social Security disability benefits for current and past due child support or alimony. And the Internal Revenue Service is allowed to garnish Social Security disability and retirement benefits for delinquent taxes.

Also, in addition to the IRS, other federal agencies may be allowed to garnish Social Security disability benefits.

A. The source of money is not the issue here, only that there is a checking account that can be garnished. It does not matter where the money came from.

Answer: Creditors and debt collectors cannot levy any Social Security benefits (or child support) in your bank account. But, you have to prove to the court that these funds are Social Security benefits.

A levy is when the creditor receives a court order to seize the money in your bank account. For a certain amount of time, your bank account is frozen and you have the opportunity to get the levy lifted. However, if the levy isn't lifted, the creditor can take the money from your bank account until the debt has been satisfied.
