View Full Version : Should I modify my support order if I have a decrease in wages and cost of living inc

I live in Florida and pay child support for two children living in Pennsylvania. I have had a drastic decrease in wages. When my children were younger my ex claimed she watched the children in the morning to feed them and get them on the bus. This is no longer accurate as they are old enough to get themselves on the bus and admitted the girlfriend does not watch them. I contacted my attorney in PA and she said not to modify the order because there was a possibility I could be ordered to pay more due to the increase of living cost. Is this accurate?

The only way to know what a Judge will decide is to go to Court and ask for an Order. How drastic was the decrease in your salary?

Of course, the Attorney knows the facts a lot better than I do!

In many states they have an online calculator. You could try looking at one of those and see how it comes out for your case. Then you can make a better informed decision.

Cost of living in most places has nothing to do with it, it is based on a percent of income.

Also her feeding the kids and getting them ready in the morning really has nothing to do with how much you pay either, it is the amount of time she has custody, ( days she has them compared to days you have them) ** varies by state.

And are you sure you talked to YOUR attorney, not HER attoreny? Just does not sound right to me.
