The father of my son want to take me to court for a custody battle because he wants full custody of my son that's not born yet he will be born on August 8th but I'm not giving the child his last name and I'm not putting the dads name on the birth certificate nor am I having my baby in the same state but he wants full custody so he won't have to pay child support I haven't displyed any type of bad behavior I'm in school have a job and apartment with no record I'm 18 he's 23 .can he fight me for custody?

Sure he can if he is the father. He can also pay support if he doesn't become the custodial parent.

Its not likely but anything is possible. Be sure to attend everything the court asks for. Hearings, mediation etc. Also try not to short the father on visitation. Keep it reasonable and you should be OK.

Without more details, we can't begin to answer you. We need to know what states you are in, why you are in different states, what his financial situation is what yours is etc. Even then there is no predicting what a court will rule.

But courts DO favor the mother, especially for a new born. He would probably need to prove not only that he could provide a better home but that you couldn't provide a good home.
