View Full Version : Can landlord serve notice to quit under restraining order?

I have a restraing order against my landLord for harassment and threatening. He mustn't have any contact with me but may still live in the building.

Today I got a notice to quit from him with a few angry wording. May he do this? State is Maine.

Retaliatory evictions are illegal in ME http://www.maine.gov/tools/whatsnew/attach.php?id=27933&an=1

It would seem his action is retaliatory and a court would not allow an eviction under thise circumstances.

He handed it to you? Were the angry words spoken or were they written in the notice to quit?

If he handed it to you it appears that he violated the restraing order. He should have had someone else deliver it to you.

If there are grounds for him to evict you, he may do so, He may leave the notice somewhere, or may give it to you in a way without breaking the order.
