View Full Version : How to get Tax credit in India for the taxes paid in Ireland?

Hi,

I was on a short term assignment in Ireland for 90 days.(April-June).
As per Irish Tax Revenue, its mandatory to provide PPS Number to the employer, else 41% emergency tax will be cut per month.
I was not able to apply for PPS Number when I landed in Ireland(i.e April) because to get PPS Number you need a Bank Account, to need a Bank Account you need GARDA registration.Getting all these took a month for me to apply for PPS Number and I applied for PPS Number on May 5th, it took a month to get my PPS No processed from Revenue which I eventually got in the month of June

Based on above my April and May salary was taxed at 41% emergency tax due to the absence of PPS No.Since I had my PPS No for the month of June I was taxed 20% of 2733.34 Euros and amount exceeding 2733.34 Euros was taxed at 41% as per tax certificate.

My question is am I not eligible for the Tax refund of emergency tax which was cut for the month of April and May at 41% since I didn't had my PPS number at that time?

Response for the above from Ireland Revenue is as below

"Please note you did not complete 183 days in Ireland for 2011. Therefore you are non resident for tax purposes in 2011 and a refund cannot be issued. You must apply to your home country for a credit for tax paid in Ireland. You can only be resident in one country for tax purposes. As you failed to meet the requirements for residency in Ireland you are tax resident in India."

Can anyone suggest me how to get the tax credit in India which is my home
Country for the emergency tax paid in Ireland?
