View Full Version : Can I sue for defamation of character if neighbor keeps making false complaints?

OK. We own 4 pitbulls which are family dogs. I have a neighbor that just moved in around December of 2011. Him and his wife keep calling animal control with false complaints about my dogs. They are calling saying my dogs are aggressive, I'm breeding, I have illegal kennel... etc. Now all these complaints have been investigated by animal control and every one of them has been found that we are not in any kind of violation and my dogs are not aggressive and we have all 4 of them licensed and current on vaccinations. He went as far as trying to get another one of my neighbors to call and complain but that neighbor said he don't see a problem with my dogs. The man got upset and told him if he doesn't help him then he is going to do whatever it takes to have my dogs removed. I have been here for 3 years and in those 3 years I have had 3 or 4 complaints in 2 years before he moved in but those calls also were found that we are not in violation of anything. Now that he has moved in there is 6 complaints since Dec. 2011 to now. He even called using a different spelling of his last name and different numbers for his address so that it looks like there is more than one person making complaints. I have actually been issued a 3rd party citation by his wife and I have to pay $160 just to get a court date to prove my case. PLEASE SOMEONE HELP ME ON THIS!! CAN HE BE SUED FOR DEFAMATION OF CHARACTER??

They are merely reporting dogs they feel are a danger, and it appears 4 other people felt the same way before they moved in also. And they are complaining about the dogs character not yours.

There is no law suit.

That is not true because the calls from before were all the same person as well. He is making FALSE complaints because I do not have aggressive dogs, I am not fighting my dogs, I do not breed my dogs (my females are fixed) and I do not have an illegal kennel. All this has been proven by animal control. Therefore he is making false statements and is trying to make me look bad as a dog owner.

If you are totally in compliance with the law in your area and your statements are true, let the neighbor keep reporting you and then sue for harassment.

I don't see defamation because I don't see any financial damages on your part.

Eventually the Police/Animal Control/anyone else will stop responding to the neighbor's complaint.
