View Full Version : Being sued in small claims court, for credit card, I have no money to pay this.

Hi...
I was collecting SDI because of a medical problem, when feeling better I did day care for my 2 Grandchildren.as the reached the age of 15 months I could no longer care for them because of a bad knee and could not lift or bend.I had the knee replaced and that took awhile to heal. During this time I had many medical problems.. within 2 years had to have the other knee replaced.. and never could go back to care for the children, I now receive $ 490.00 a month and my Husband is also retired. So there is just enough money to pay the household bills. What will happen to me any Idea"s I owe about 9000.00 total in credit card debt, I stopped payments in 2008.

Poverty and inability to pay is not a defense. A judgement will be awarded the plaintiff if they can show these are your debts. That judgment can be used to attach certain assets, like bank accounts etc. If you are judgment proof (meaning you have no income or assets to attach, then they will just hold the judgment in case you do.

Agree, they will win a judgement against you, They will be allowed to attach ( take money that is in the bank in your name.
