View Full Version : Can I sue a tradesperson for damages from 2007, five years ago?

It has been 5 years since a plumber doing work in my home last worked there. Over time we have discovered repeated acts of negligence that have resulted in thousands of dollars of repairs and forensics to discover not only acts of laziness and stupidity but deliberate shortcuts that have caused damage and discomfort. It's only in the fullness of time that we realize the extent of this man's negligence amd we want to sue him in Ontario small claims court.

Is it too late? Thank you for you help.

Exactly where did the issues start to present themselves? If it was within a year of the initial work, the contractor should have been called back. The problem here is that the original contractor can no longer take responsibility because you have had other contractors work on them. The original contractor really should be giving the chance to "make good" on his work.I know that if I had a customer call me after 5 years and say there were problems with my work that ANOTHER contractor found, I would not really pay much attention to it. It would be the new contractors word against mine and who know what the new contractor would have done to make it appear as if I had done something wrong. They do it... not all of them but when they really know they can hang their hat on a few minor mistakes as a way to get a job, they do do it.[/I]
