I just got my support stopped by the custodial parent , we went to court on March 12, and went to the main office and gave the necessary papers given by the judge and but they are still taking out the payments from my checking.. she also had closed the bank account.. what can I do and where do I go or call.. Im in nyc..

Was this taken directly from your paycheck? If so in NY it takes from 4 to 6 weeks for the paperwork to go through. You very well may have to take the custodial parent back to Court to collect the overpayment.

I don't understand the "she also had closed the bank account" part. If the account is closed the support can't be deposited into that account.

Were you responsible for filing the Order stopping support OR was the Court going to do it?

I'm also in NY.

She was the one who decided to stop payments for who knows what reason so we agreed for me to give her a good amount cash monthly basis.. after the court date the judge sent us to broadway somewhere to stop the childsupport an the person in charge said . "oh good you came to the right place." and we gave him the papers from the judge, so he can do the process faster.. but he even said your good to come here if not the payments would have been coming out still from your acccount.. so where can I call right now I work over 12 hours a day and can't make it to the place in time, Yes she ha an account which I went with her to take out funds, supposedly the acount was to be closed as well. So this has been two payments taken out could the account still be open if not do they reimburse me back I f so, how soon..

It all depends on the staffing on the State level - there is a number you can call and they can tell you the status. It should be in your papers. Various caseworkers have various extensions so I can't tell what it should be.

I would expect it to take 4 to 6 weeks. As soon as the mistake is realized the authorization to stop and refund is issued. I have seen that take an additional 4 to 6 weeks. It's a great system when it works but when something like this happens it's time consuming and frustrating.

Check your paperwork for a phone number.

I understand.. and there isn't a phone number. That is why I asked . So u mean from the date of march12th 4-6 weeks. Oh boy..

I'm just walking out the door - I'll be back in a couple of hours and I'll post the phone numbers I have.

And I agree - it is ridiculous in NY.

At the very bottom of this page - https://newyorkchildsupport.com/dcse/custodial_parent_info.html#local_office - you click "get the phone number" (or something similar), type in your County and (in theory) it provides you with the info.

Let me know if it doesn't work.
