View Full Version : More than 5 yrs on F-1, Form 8843 - line 12

Hello,

I came to the US in 2006 and have been on student visa since then. I am filing Form 8843 for year 2011 and I need help for line 12. It asks if I was in US for more than 5 years and if my answer is "Yes", which it is, then I need to "provide sufficient facts on an attached statement to establish that you do not intend to reside permanently in the United States."

My question is what kind of document(s) do I need to send to establish that I do not intend to permanently reside in the US?

I have read Pub 519 but I still do not understand what to do. I have also searched online but was not able to find the answer.

I also did not have any income in the year 2011 so I am only filing Form 8843.

I have a couple more questions:

Given that I first came to US in Aug 2006 and my 5 years were completed in Aug 2011, what should I put in line 4b of Form 8843: "Enter the number of days in 2011 you claim you can exclude for purposes of the substantial presence test" ?

Also, for my previous question: Is it compulsory for me to send any documents/statement? Or is it that I need to send them only if I want to keep on being considered a non-resident alien for tax purposes?
