View Full Version : How long in court does it take for one party to sue another for a "partition" ?

In regards to a California property being owned jointly, 50/50 by two parties, what is the process and timeframe in court for party "A" to sue party "B" to obtain a "partition" and force party "B" to sell the property? Thans in advance! CHRIS

You should have asked this question in the other thread, but the answer to this question would best be given by a California attorney experienced in property litigation. It will, at a minimum, require the filing and service of a complaint, the filing of an answer by the defendant(s), perhaps some discovery and motion practice, the appointment of a special master (or whatever it's called in California) to either come up with a plan to subdivide the property or to sell it, and the division of the proceeds.

Perhaps a year or more.
