View Full Version : PY NJ Resident, Worked in NY for sometime. W2 issue.

Hi
I am confused with my W2 and about how to file taxes for NJ and NY.
Here's the scenario,

I lived in NJ from Jan-Nov working for Company A. Company A put me on NY project from April to Nov, so was living in NJ and working in NY for that period. I moved to VA in Nov end and worked there for rest of the year for Company B

Problem:
Company A sent me 2 W2s, each for NJ and NY. W2 for NJ has federal wages $X and NJ wages as $Y (slightly higher than $X). W2 for NY has no federal wages and NY wages as $X (same as total fed wages listed on NJ w2).

However, my Company A gave me how much I earned while being in NJ and NY, which is more or less like 1/3 of $Y earned in NJ and 2/3rd earned from NY project.

I am not sure how to file and report my wages to NJ and NY, to avoid paying taxes to NY for part of the income I didn't earn there.

1. Start by completing a NY State non-resident tax return, reporting the NY wages per that W2 for NY State.
2. Then the NJ return as a part-year resident. You figure initial taxes based on the NJ W2, then take a credit for taxes paid to other jurisdictions (namely NY). The credit for NY tax paid will most likely completely eliminate any NJ tax owed.
3. Finally you do a VA part year resident return to cover income earned while living and/or working in VA.

I have a follow-up question with your first point.
NY W2 lists complete earnings from Company A (which includes money I made staying and working in NJ as well).
When, the tax form asks me to allocate amount from total earnings to NY, what amount do I allocate? Full amount as listed in W2 (NY wages) or the breakup that my company A sent to me?

It seems that Company A believed you worked in NY for te entiore time you were their employee in 2011, including from January through March. If during that time you actually lived and worked in NJ (no presence in NY) then they have made a mistake, and you should contact the payroll department to have them issue a corrected W2 for NY State.
