I am a G4 visa holder through my wife for the last 10 yrs have always been filing 1040 jointly on recommendation of a tax company.

I pay all taxes federal or state like any one else... Am I doing th eright thing...

No, you are NOT filing correctly.

Holders of the G-4 visa are EXEMPT from federal income taxes. If you live in New York, you are also exempt from state income taxes.

You can amend your 2009, 2010 and 2011 tax returns to correct this error; you CAN still file jointly. It is too late for 2008 and earlier.

You will need to submit Forms 1040X, 1040 and 8833 (to explain the exempt status).
