My employer disclosed the results from my mental evaluation back in 2004, to an outside medical consulting firm without my consent.
This firm coordinated to schedule me for a recent mental evaluation to determine if I am emotionally stable enough to maintain my employment.
Regardless, was my employer in the wrong for disclosing these medical records from 2004 without my consent?

Yes, I agree, they had no business disclosing the records. Now, what is your recourse ?

My employer disclosed the results from my mental evaluation back in 2004, to an outside medical consulting firm without my consent. I obtained an independent mental evaluation from a psychologist which turned out to be in my favor. My employer had this evaluation on file but chose not to disclose it, because the content based message of this medical report puts my employer in a bad light.
Regardless, was my employer in the wrong for being selective as to which mental health records they chose to disclose?

"my mental evaluation back in 2004" did your employer have this evaluation done or did you have it done on your own? Who gave the emplyer the results?

Who paid for the eval in 2004 , if it was for your job or part of a job evaluation, it belonged to the company and I will assume they want another review done. They may give your medical info they have in their files, to medical companies that will be employed by them to review employess
