Hi everyone,

I'm filing my 2011 taxes. I was under OPT till September 30,2011 and H1-B visa from October 1,2011. Do I qualify for the tax treaty with India? What is the deduction that I can get from this treaty?

Do I need to file 1040NR-EZ and Form 8843? Do I need to send the copy of my H1-B visa along with the completed forms?

E If you had a visa on the last day of the tax year, enter your visa type. If you did not have a visa, enter your U.S. Immigration
Status on the last day of the tax year.
F Have you ever changed your visa type (nonimmigrant status) or U.S. Immigration status? Yes No

Of these years changed, attach a statement showing the new visa type and the date it was acquired.

If you did not complete 5 years on F1/OPT, you will file nonresident tax return. If you have income during OPT, you can claim treaty deduction.
