View Full Version : House we are renting is in foreclosure, what do we do?

We have had a contract for two years and our renters contract was up Feb. 14th. We called the landlord and he told us he was more then happy for us to stay but hasn't sent us another contract. Well we just found out the house will be auctioned off march 6th at noon, what is our rights? How long will we have till we have to move and should we pay march's rent?

Big difference between auction off and foreclosure, which one is it? Where is this house, what state. Most likely if auctioned they will consider you a month to month tenant and could ask you to leave. Then again the buyer may want a tenant. Rights, you have the rights of a month to month tenant in your state. Did your original contract/lease have any clause about automatic renewal?

There is a sticky note at the top of this forum that deals with this question. Since your lease expired you are a month to month tenant. Under federal law you have to be given 90 days to vacate. However, it depends on who will buy it. If the lender takes over, they may prefer that you stay.

I would hold onto the march rent until you find out what is happening.

I agree, I would not pay March rent, but do put it into savings and don't spend it, since you will need to pay it to someone. Also the landlord is suppose to give you the deposit back, you need to discuss this, often if he is losing the house, he is not going to have it to give you.
