View Full Version : Child Cruelty Conviction/ Expungement/ Live Scan

I was convicted of DUI & Child Cruelty (kids in the car) in 2008. I had both convictions expunged in 2011. I am a child social worker and applying for jobs. Does anyone know if these convictions will still appear on my live-scan? I learned from another website that other crimes will not show but anything against children and sex crimes continue to appear... but will state DISMISSED. Dismissal is better than the conviction just standing "as is," but still looks horrible to an employer. I am asking the question because if it is going to show then I need to be prepared to broach the subject in the interview; however, if it does NOT show, I will know to keep quiet. Any help is greatly appreciated!

You don't have any control over what shows up. A better way would be to find out what the criminal history question asks so you can know how to answer. Some state specific questions will tell you to omit anything that was sealed or expunged, it depends. Find out as much as you can from the court of conviction, a criminal lawyer, a legal aid office tied to your court of conviction so you know what to expect
Some things are expunged at one level but not another and it is a tricky matter

If it was me, I'd BELIEVE that the offenses were expunged. If they weren't, you'll FIND out. If they were, you'll get the job.
