What have you filed in court ? Have you filed to have paternity proven in court, have you filed for visitation, and filed to have birth certificate changed.

Also where you married still when the child was born ?

Get your wife a gift certificate or something and tell to go out to eat with her friends and that you'll take care of the daughter and when she's asleep or whatever get the certificate out erase his name and write yours good luck

This is the Family Law forum. Answer here need to conform to actual law. Making a change to a copy of a birth certificate does nothing and may be considered illegal.

How did his name get on there in the first place. In almost all states, the husband is considered the father.

ANY question on law needs to include your general locale as laws vary by area.

But if the birth certificate is wrong you have to go to court to petition that it be changed.
