View Full Version : US Tax return for wife and child and procedure to apply ITIN from outside US

Hi,

I was in US during 2011 on H1B visa. My son and Wife were in US on H4 visa for period of 2 months.

I have returned back to Mumbai, India and understood that I can file return for my family as well and earn tax credits.

I do not have ITIN (Tax identification Number) for my family.

Please advice whether I could able to apply for ITIN from Mumbai? If yes, what are the documents required and how to go abut filing the US tax return for 2011 without causing any delay and also avail tax credits.

You can file joint return as residents and claim your child. ITIN application is attached with your tax return. You need copy of passports duly notarized as per IRS requirements. Read instructions to form W7.

All of whjat MukatA says is accuarte.

However, if you are filing from India, you must not only get the passport photocopies notarized; you must also get an apostille from the Indian government. The apostille is a certificate of authenticity from the Indian government to verify that the passport are in fact authentic passports.

ITIN applications from foreign countries get greater scrutiny by the IRS and are rejected more often. For this reason, you may want to use a Certifying Acceptance Agent (CAA).
