View Full Version : What do I do if last year someone else claimed me on tax refund?

I have a huge problem please help. In 2008, and 2010 some one claimed me and my children on there taxes. I lived by myself with my children. I was head of household no one had the right or could have known our ss#s I don't understand and I don't know what to do I keep getting automated systems from IRS and I desperatly need the money after all it is mine I do deserve it... Help?

Have you filed tax returns for 2008 and 2010? What messages are you getting from the IRS?

Assuming you did file and got a notice from the IRS, there SHOULD be a phone number on the notice which eventually will allow you to talk to a human being. It may take awhile (because the IRS is VERY busy fielding calls during tax season), but you WILL get through if you have the patience.

If you do NOT have the notices, call 1-800-829-1040 and work your way through the menus to talk to a human being. Again, be patient and expect to be on hold for up to two hours.

You need to get the 2008 issue resolved FIRST, because the deadline to claim refunds for the 2008 tax season is less than THREE months away.

Once you get through and explain the problem, they will send you paperwork in the mail that will require you prove you are whom you say you are and that your schild is in fact YOUR dependent. They will then process your 2008 (and, eventually, the 2010) return(s) and you will get the refunds that are due to you, plus interest.

The IRS will NOT tell you who is the person who illegally claimed you, but they WILL deal with them as required by law.
