My nephew has been in gwinnet county for 95 days they have no proof ,no witness,no finger prints, evidence how long can they hold him?

It's not as simple as that.. He probably HAS a lawyer, who probably had him waive his speedy trial rights. If that's true, there IS no time limit.

If that ISN'T true, then he can be released IMMEDIATELY... But, you're going to need MORE than MY opinion. You're going to need somebody who can DO something about it, and that would be a good lawyer.

You're MISUNDERSTANDING the situation... He's ALREADY been charged. They did that either BEFORE they arrested him or within 72 hours AFTER. THAT was the only time limit they needed to meet, and I'll bet you that they DID.

If they're seeking an indictment, it's just icing on their prosecution cake, and they probably have as much time as they need.

He has been charged, he would have been to his first appearance * unless he waived it* the morning after he was arrested. He would have had charges read and had a chance to plead.

He also will have had bail set and is in jail because he can not make bail. He will have had an attorney appointed.

What they are doing now, is waiting for
1. ether side to make motions and have hearings on those,
2. or have a date set for a trial.

Sorry, there has to be some "evidence" or they would not have arrested him, perhaps bad or wrong evidence.

But in Georgia, I have seen it take almost a year to get to trial.
