"Well first off I have three questions.....

One) I am going to turn 17 in one month right? Well, like I want to have sex with my boyfriend of one year.... And he is going to turn 21 in July. So I was wondering if it was possible WITHOUT parental consent?

Two) Again I am almost 17 years old.... And I was wondering if I could possibly get emancipated or able to runaway without getting into trouble. Like... I was sexual abused at 15 and told at 16 and it was my stepfather and my mom loved him and told me not to send him to jail. So I didn't. I wish I did now though..... But anyways She goes to his house all the time and is technically obsessed with him right? I personally think she blames me for telling on him. He influences her to do things. Like take my phone for things my sisters do too. Not take me to the doctor when I need to(although that just might be her doing that) etc.. So I was wondering IF I had a place to go... If I could? I have searched everywhere but everythings all jingled up so I don't know.

Three) IS it possible to send my step dad(the guy that sexually abused me) to jail after he molested me to jail after I already said I didn't want him to, and the court approved?"

What State? In some States the age is 16, in some it's 17, in some it's 18. If it is illegal in your State it is illegal without or without parental consent. In fact, if it's illegal in your State and your parents consent, they can be criminally charged. The age difference between you presently is three years, right? That matters, too.

No, there is no such thing as legally running away. By the terms of the expression - it is illegal. How does your boyfriend play into this? If it is with his HELP - or if you go to stay with him - HE can be criminally charged.

IF you can support yourself, have your own apartment, have finished your education (even at 17) you can be legally emancipated. Do you meet the criteria?

No, you can't agree to one sentence and then change your mind and want another UNLESS/UNTIL your step father violates whatever the terms of his sentence were.

If you mother is not taking you for medical treatment she is neglecting you and you can report her and have her charged. Of course, you'll end up in foster care from what I'm reading, and I don't know that you want that.

You need to speak to a responsible adult and tell that person that you believe your mother is treating your unfairly because you reported the sexual abuse at the hands of your stepfather.

The Courts are not going to be interested in you losing your cell phone because your mother is or isn't angry with you or your sisters.

Again, I have stepchildren and I'm a legal investigator. I get a very strong feeling that the "almost 21-year old" boyfriend is the source of a lot of your unhappiness with your mother and your current living situation. If so, your Mother can have him charged with parental interference.

I'd walk the walk you appear to be headed for very, very carefully.

I'd also wander over to the Family Law Boards and read about teen-age mothers. Pregnancy is a result of sex and no birth control is 100%. Every boyfriend is in the situation forever - or, usually, until the child is born.

As noted we need to know your general locale to determine whether he might be in legal trouble for having sex with you.

What is not clear is whether you ever reported or pressed charges with the police against your step father. If you did not, it may not be too late to do so. If he was charged but convicted on a lesser charge, then it is too late.

Even if you qualified for emancipation, which is VERY hard to do, by the time it works its way through the court you may be 18. So its is probably not worth the expense.

Finally, getting back to sex with your boyfriend. Is he pressuring you for sex? The more he pressures, the more I would resist. NO ONE should engage in sexual intercourse unless they are financially, physically and emotionally prepared to have a child.

Get married. Im 17 and married. Nothing wrong ! Im out of my parents house ! & then enull the marriage later if you don't want to be married to your boyfriend. :)

This is a legal forum, please make sure your advice conforms to actual law. Most places do not allow a minor (under 18) to marry without parental consent. Also, its not that easy to annul a marriage.

Where to start? Well, the "legal" advice is incorrect. It's annul not enull. You aren't married to your boyfriend. The marriage transforms him into your husband. An annulment is not a given.

People who marry at 17 often don't continue their education and end up somewhat illiterate and marginally employed.

Lets just say the OP is in South Carolina for example. The age of consent there is 16, so she can have sex at 17.. The only issue here would be if the mom ordered the 21 year old from seeing the daughter. If he continued to see the daughter mom could file charges for other things, ( not rape) against the 21 year old.

Not enough info on step dad, if you already filed a police report and there already was a court hearing, but you asked the court not to send him to jail, then NO, the case is over, he was sentenced and so on.

And no at 17 you can not just move out.
