My severely mentally ill son who is 19 and a has a record with 2 felonies and on probation recently was not taking his medication correctly got into a domestic argument that led him to acting like an idiot pushing his sister down & acting like he was going to throw a chair at me. Now before everyone starts saying things about us wanting to drop the charges UNDERSTAND this! I had been working with his probation officer trying to get him in a program where many things in his life will be addressed. The po doesn't know how he was even convicted when he really doesn't understand the process nor how the legal system works she thinks he should have been evaluated for fitness to stand trial in the first place. Now upon reviewing the police reports today I noticed the arresting officer wrote the wrong name where my sons name should have been. On both affidavits. Does this create a technicality that will affect my son. Also can my daughter and I sign waivers of prosecution? The point being his arrest has now violated his probation and if these charges go away he will go into this program instead of sending him to prison. He came out after doing a year worse then when he went in. If they send him to prison he will be ruined for life. Any suggestions?
