View Full Version : Will I be divorced at my default divorce hearing in California without all my bills?

I assumed I would get a default divorce through the mail without having to appear in court but instead I got letter with a hearing date that told me to bring all the bills I want to separate from the time of separation. However, my spouse never provided me copies of some bills and probably won't. I took her word for it about how much debt there was and wrote it into the paperwork as I divided the debt evenly. My question is will the judgement still be served in the hearing on that day if I don't have proof of all the bills?

Where? Probably not. The Court wants proof for some reason.

This is in LA County. So I suppose I should try and get copies of the bills my spouse has not provided to me if I can.
Some more background is that the way I have divided the debt is that I have agreed to take all debt (credit card, taxes, etc.) other than her school loan. Some of her school loan was used for living expenses and that amount equals about the same amount of debt that I am taking. But I don't have access to her school loan documentation to prove that- only she does. However she has been reluctant to go through the work of compiling the proof and sending it to me. It seems like she just guesstimated and gave me a figure of how much we used of her school loan on living expenses. I have a hard time believing it was that much but I'm taking her word for it.
