I'm in the same problem I'm in the military and my babyfather is watching our son but his mother is taking care of him he try to get joint custody and child support.He never had a job just got his GED. What can I do? I'm still in ait don't come home till jan 23.

You really should start your own thread instead of posting on an old one like this. {Moved}

So, what is it you want to know? Yes, of course he can ask for custody rights. There is nothing to do. He would make the first move. And with slightly more than a month to go, it is doubtful that he can do anything until you return.

Also, under federal law you can get a postponement for at least 90 days.

I will say this, you said he is asking for "joint custody" that is not the same as "custody" it is very common today for men to ask for and get joint custody, since it is his child also and why would he not be entitled to have the child 1/2 of the time.
