View Full Version : Do You have to pay support if the child moved out, then back in later?

The child moved out when 17 lived with girl friend. Moved back in w/mother at age 20. (After boy friend moved out) My other son moved out when he was 16 worked went to school and rented apt. Moved back in with mother after boyfriend moved out. I got married now she wants child support?
Will I have to pay child support?

What State and what does the Order say? Did you go back to Court following the move out and request that child support be stopped?

The State is NY and there has never been an order. We just had a verbal arrangement. I have paid her support since 1995. I quit when the boys moved out last year. I got married last month and now after 16 years she files for support?

NYS allows support until age 21. However it does not allow for retroactive support. So any support would start from the date of filing.

So, if the children are living at home and under 21 then she could win support.

On the other hand, I'm concerned about this business of moving out at 16 and 17. The 16 yr old could not legally rent an apt until 18 and allowing a 17 yr old to move out and live with a girlfriend would seem to demonstrate unfitness. Where were you when this was happening?
