I have an income from US from 01K Withdrawal. My Tax consultant in US has filed 100NR form as Single with 2 dependants (My Son and daughter). I believe even though I file Single for tax purposes, I can still claim exemptions for my daughter and son as they are dependent on me. My daughter is US citizen having us social security no and my son is Indian Citizen and has ITIN no.

My Next question is Can I claim child tax credit for the my daughter even though she was with me in INDIA for the whole year 2010?

Your tax consultant filed the Form 1040NR incorrectly.

To claim your children, you must be a student or business apprentice during 2010, and your children must have spent at least SOME time in the U.S. in 2010. Expect the IRS to disallow their exemptions.
