View Full Version : Medical privacy or HIPAA violation?

A nurse at my husband's doctor got his cell phone number out of his file and started calling and texting him for personal reasons. She is trying to start a romantic relationship with him and he has continually told her to stop but she still refuses. Is this a privacy or HIPAA violation? We are unsure as to whether to file harassment charges or a HIPAA charge, or both.

Not necessarily a HIPAA; cell phone number is not private info even if she did go in his file (she is an employee although at this point should not be one!). I think harassment charges, but possibly restraining order specifying no contact, if it can be settled amicably.

I agree, clearly not a HIPPA violation since no health info was disclosed. I would report this to her employer as well as the Police. However, making calls and texting is not necessarily illegal but it could evolve into stalking.
