Is Walmart responsible for my medical bills for an injury I received at one of their stores? An employee yielding a box cutter was slashing at another customer who was pushing her, during a black Friday sale. After lacerating the man she hit me with the box cutter on my backside leaving a deep 3 inch long laceration that required treatment by EMS and a tetanus shot a day later. Now I have to have lab work done to check for blood born illness'. Claim was filled out at Walmart and they called the ambulance to have wound checked out because it wouldn't stop bleeding, but are they responsible?

They should pay for the doctor and tests, merely go in and talk to the manager of the store where it happened.

Be sure to keep all receipts, and if some (or all) of your medical expenses are not covered by your medical insurance Walmart should reimburse you.

On a slightly different topic - if an employee was using a box cutter as a weapon then I believe you have grounds to file a criminal complaint against the employee, as well as civil suit against both the employee and Walmart. I'm not suggesting you follow that course, but rest assured the manager will be well aware of this and consequently should be quite willing to help resolve any issues.

Yes, Walmart is ultimately responsible for ALL of your medical tests and bills as well as whatever you ask to cover your "pain and suffering." If you lose time from work, that's also their problem.

Keep a diary on a daily basis concerning your injury, treatment, pain, restraints on your activities.

Walmart should pay your bills. You also are entitled to additional monies. Without knowing the extent of your injury (and how it will heal) it is difficult to say what you should do next.

If this is a serious problem I would consult with an Attorney.
