Here's a scenario.. leo is having an affair with Lucy, who is separated from Joe. One night Leo and Lucy were playing tennis in her back yard when Joe comes up and sits in a lawn chair. Leo demands that Joe leave, but Joe doesn't listen. So Leo picks up a rifle that was near the garbage and fires in the direction of Joe from roughly 75 feet, the bullet doesn't hit Joe but only misses him by about 18 inches. Would there be enough to charge Leo with attempted murder? If not charged with that, what?

The first question I have is. What was Joe doing there and why didn't he listen when asked to leave?

He's just sitting in the chair.. unfortunatly I don't have any more info than I put on the original post. Its something I need for a class to start a paper and I'm not really sure about it.

Then you might want to do research on the castle doctrine. You will see why more information would have been needed to form a legal opinion.

He can be changed with many things

1. attempted murder
2. assault ( various levels and names) including with a deadly weapon
3. discharging a firearm in a dangerous manner.

The charge can be changed up or changed down, often they go for the highest they think they can get. Often will plea bargain down to one for conviction
