Unfortunately he has not paid his rent for the last 3 and 1/2 months. Truthfully he has only paid for 2 months at all.(the second was late) his parents are very wealthy and he has a debit card to their account, a BMW and tons of pricy electronics and kitchen ware that he doesn't need. They just let him spend copious amounts on unnecessary items and let him drop out of classes that cost around $3800.00 (we take 3 per quarter at our university) one night he went out and bought two Xbox's along with two games, and two $800.00 displays to play on.

I was shocked, so I went to bed and then thought I would talk to him after I got back from work the next day.
When I got home he was walking out the door with a huge bag and said bye! I'm going back to Florida! (I live in GA)

I asked him if he was going to keep paying me and he said yes (haha), he would transfer the money to me when he got there.. lies.

I am unable to contact him or his mother- I have been digging into my own savings in order to pay for this place and finally found a new roommate. The only problem is his stuff, and the money he owes me- currently $1400.00 ish and his things are still here, the new roommate wants to be in on the 2nd with out any drama. ]

Also, I sent him a notice that if he did not pay me by the 7th of November (this was sent with 5 days notice) that I would start to sell off his things to make up for the rent he owed. (I haven't yet)

Option 1. keep his things to make up for the $4875.00 he will owe me (possibly worth that amount)
Option 2. sell his things to make up for the $4875.00
Option 3. take him to small claims court for the $4875.00 that he will owe me for the lease.
Option 4. (this is where you fill in the blank if you have any other ideas)

P.S. he doesn't work, so it will be mommie and daddys money

If he has left then take his stuff and put it in secure storage. Send him the bill for that also. Then go to court (small claims) and get a judgement against him. You can file a lien on anything he owns and also ask the judge what to do with his things. Follow what the judge says and they may release his goods to you for repayment.

For the time being do not sell nor destroy anything and make sure you inventory as well as take pictures of everything.

Definitely do what califdad suggested. But here's the problem other than selling off his things, you may have a hard time collecting. If he lives off his parents he has no personal income or assets. So there is nothing for you to collect from.

After you file in small claims, I would send a copy of the notice to his parent's home. So they are aware of what a dead beat they have raised.
