Is it legal for a 15 year old to date a 31 year old with parents permission in the state of Idaho?

If the 'dating' involves ANYTHING sexual, then yes. If not, then no, but I'm sure both families would disapprove.

There are no laws involving dating, but sexual activity is out.

But j_9 has a pertinent question. While I won't jump to the conclusion that he's a pedophile. Any 31 yr old interested in a 15 yr old has severe issues. And any parent that would allow a 15 yr old to date a 31 yr old should be brought up on neglect charges.

I suspect you are the 15 yr old and that you haven't gotten permission yet, but think you can convince your parents to allow it. If they are good parents they won't.

And YOU should be running away from any 31 yr old interested in you as a dating partner. Such a person would not be good dating material.

A 31 year old would be either mentally and emotionally very immature or only interested in your girls for sex. Sorry there is no other reason for other interest.

Also no parent who even remotely loves and cares for their chld would give permission.

In Idaho, a minor under the age of 16, must have both parental approval, AND court approval- to marry. I couldn't quickly locate 'dating', however, I will assume that if the court has to approve the union, there is likely much you can find on legal ramifications of dating a 31 year old adult- do your homework.

I would suspect that any parent who would allow a 15 year old to date a 31 year old man, would be subject to child protection laws, regardless if the parent approves or not.

You, and your parents, and this man, could all be subject to various laws that are in place to protect children under exactly these circumstances.

You are not seen as an adult, and because of your age, not capable of making a choice whether to date a 31 year old man. It is assumed that you are being exploited and manipulated, because you are a minor. There are reasons laws exist to protect children, and this situation is a good example.

Generally speaking, any adult male (in your case), who is attracted to a minor, would likely be seen as having psychological problems to mental health professionals, but to the law, he is seen as a criminal.

This man you are interested in, is indeed leading you down the garden path in my opinion, and likely trying to convince you that it is okay to 'have a relationship'. That his age is 31, and you are a minor, even with permission of your parents, does not make it legal. Your parents are supposed to protect you, because you are a child, from adult males. Simple as that.

If you lived next door to me, and I knew your age, and the identity and age of this man, I'd report him in the blink of an eye. And so too would any teacher, or any other professional who has an obligation, by law, to report child abuse, child exploitation, and child endangerment.

If you aren't sure of the legal ramifications past what you've posted in your question, do your own research, and see if you can't understand why this 'relationship' is not seen as appropriate, legal, or healthy, by any organization or legal statute.

I hope you are a concerned bystander and not one of the parties involved.

Does the 31 year old realize how restrictive dating a 15 year old would be? Can't serve a 15 year old alcohol. Possible curfew laws. Limits on places to go. No sexual contact at all until the teen is 18 years old (even kissing could be seen as a violation of the law if it goes beyond a kiss on the cheek or peck on the lips.)

Where did the 15 year old and 31 year old meet? If the 31 year old is in a position of authority over the 15 year old then other rules and regulations could apply such as employment contracts.

The Idaho statutes on Sexual battery. Please note that this applies to sixteen and seventeen year olds who are considered old enough to consent to sex/sexual acts with persons no more than five years older than themselves. Under sixteen and the teen can't consent to anything of a remotely sexual nature.

18-1508A. Sexual battery of a minor child sixteen or seventeen years of age -- Penalty. (1) It is a felony for any person at least five (5) years of age older than a minor child who is sixteen (16) or seventeen (17) years of age, who, with the intent of arousing, appealing to or gratifying the lust, passion, or sexual desires of such person, minor child, or third party, to:
(a) Commit any lewd or lascivious act or acts upon or with the body or any part or any member thereof of such minor child including, but not limited to, genital-genital contact, oral-genital contact, anal-genital contact, oral-anal contact, manual-anal contact or manual-genital contact, whether between persons of the same or opposite sex, or who shall involve such minor child in any act of explicit sexual conduct as defined in section 18-1507, Idaho Code; or
(b) Solicit such minor child to participate in a sexual act; or
(c) Cause or have sexual contact with such minor child, not amounting to lewd conduct as defined in paragraph (a) of this subsection; or
(d) Make any photographic or electronic recording of such minor child.
(2) For the purpose of subsection (b) of this section, "solicit" means any written, verbal or physical act which is intended to communicate to such minor child the desire of the actor or third party to participate in a sexual act or participate in sexual foreplay, by the means of sexual contact, photographing or observing such minor child engaged in sexual contact.
(3) For the purpose of this section, "sexual contact" means any physical contact between such minor child and any person or between such minor children which is caused by the actor, or the actor causing such minor child to have self contact.
(4) Any person guilty of a violation of the provisions of subsection (1)(a) of this section shall be imprisoned in the state prison for a period not to exceed life.
(5) Any person guilty of a violation of the provisions of subsections (1)(b), (1)(c), or (1)(d) of this section shall be imprisoned in the state prison for a period not to exceed twenty-five (25) years.

But it is obvious, that he has mental problems for even liking me, in that way.

Cat1864- Hes my sisters good friend. We've never done anything "illegal" together, and I don't plan on it, so no worries.
And I guess you could say, he just has a crush on me.

So he has initiated this? I would talk to your sister and parents about it. Its one thing if you had a crush on him but he was just being nice paying attention to you. But if he's the one with the "crush", stay away from him.

I am so happy you have a head on your shoulders, and you're thinking this through. We have had many questions of a similar nature from young girls such as yourself, who want to be told that it is okay. All we can do is hope they listen, when we point out that it is not.

I'm glad your curiosity got you here, and that you are not planning to have any kind of relationship with this man.

I am very impressed that I'm seeing instict and common sense. Very impressed.

You made the right choice. As a 31 year old, he should know better than to go near a 15 year old on a romantic level. That does not bode well for him.
