Fr Chuck I pled guilty to a non criminal offense in 1996 after being charged with a misdemeanor in NY
I am considering applying for a Social Worker license in Ga equivalent to the one I have here in NY (since violations here in NY are not crimes, my license was not investigated or suspended)
Since I was convicted of a non criminal offense in NY (dis con), NY sealing law 160.55 orders NY state to notify the FBI to expunge info pertaining to the arrest from their files
I checked my FBI record a few years ago and the fingerprint card was returned to me stamped no arrest record
I understand the Ga licensing board probably checks the Ga GCIC for any arrest info. A disclaimer on the social work application for licensure states that the applicant is aware that your criminal record and including confidential info will be checked
So what I want to know is will my expunged record show up in the GCIC files as "expunged" and if so does that mean they can unseal my record? Would LE be releasing the info to the Ga licensing bureau? How does it work?
I was once told that if you have an expunged arrest and LE checks it that your prints will still be in the system along with your name and SS# but the info about the arrest will be deleted
Is this true?
