View Full Version : Misdemeanor and Felony Charges, Jail Time?

Hello, I was arrested in June on a third degree misdemeanor charge and when I went into court I got put on the Holmes Youthful Trainee Act probation. Since then I was recently arrested for a felony charge, I did it and gave a statement saying so. I have not gotten any info on court dates or anything yet. As soon as it happened I reported it to my probation officer and all he told me was to keep him informed. I am a full time college student, was working part time until this incident and am an active member of a Greek organization. I am worried about my family because we might be losing our house and I am trying to help pay the bills. I am going to counseling because after a talk with the arresting officer he suggested it and I think it's worth trying because I have done these two self sabotaging things in the last five months although I have never been in trouble before these incidents.

What I would like to know is how likely is it that I will do jail/prison time?

You have several problems,

1. Without an attorney you should have never confessed to, or given an statement about the crime.

2. The PO is waiting to see what happens in the new court case, if found guility or if you plead guilty it is very likely they will violate your probation.

3. The fact you are doing another and a more serious crime, yes I suspect they will want some jail time.

4. Again you should not have said or done anything without an attorney but plead not guilty, Your attorney would then work on a plea deal to get less punishment.

So for now, do not make any more statements, don't plead guilty and get an attorney. But with all the help you have given them, yes jail time if very possible.
