I let a friend of mine and his girlfriend stay in my basement while he looks for a new place to live it's been 3 weeks and they are fighting and smoking down there all the time I've told him to stop he apologizes and says it won't happen again but it does. I told him they have to leave he said OK but it's taking to long and his girlfriend keeps saying there not going anywhere, she's crazy I don't want her to damage anything, so I haven't made a big deal about anything, what is the easiest and fastest way to get them out if they take to long. There is no rental agreement no receipt for money exchanged, I don't want to pay for a lawyer but I will if I have to is there anything I can do personally. I know I can't change they locks and they only have clothes and kitchen stuff, pots pans and a bed everything else down there is mine couch chairs and TV. I need peace and quiet again please help. I'm trying to work it out with him personally but I can't take much more of this

There is no quick, painless way of legally evicting them once they are there. Right now you need to look up your particular state's eviction laws, serve them with a Notice to Leave as they are technically a month to month tenant even if they don't pay any rent. And then follow up at the courthouse and fill out the eviction paperwork and take them to Court and have a judge sign an eviction order. Also, at the time of the eviction hearing you need to have the judge sign an Order of Removal to literally have them removed from your home. Without this other order the Sherrif may not be able to physically remove them. In some states you must have that second order if the tenants don't leave the police cannot physically remove them. Small technicality I know but you need this.
