Please start a new thread instead of posting in an old thread which may or may not have similar issues.
You forgot to ask a question. Can we assume that it would be something like "How can they do that"?
We need to know what state you are in.

And I'll add one more thing - "your" benefits? What benefits are those? GEICO wouldn't owe you benefits as a result of your wife's fatal accident.

If GEICO was the other party's insurer, could he be referring to a settlement due to him (or her estate) for wrongful death?

Could be but that would be more settlement and less benefit. I don't know - need more info.

Maybe it's a reference to the (small) life insurance carried on the driver by virtue of the policy? I supposed that would be a benefit BUT it's life insurance, passes outside the estate, cannot be liened.

No question the medical bills come first and they are an automatic lien against the policy - maybe the policy won't be thrown in until the medical bills are settled - ?

Need a little more info.

I have moved this to its own question.

First I doubt it is actually a "lien" but it is a claim that they want paid before other proceeds are paid out.
Which would be expected, Since someone has to pay the hospital.
