I filed for a divorce in state of Arizona due to my spouses admitted infidelity. We reconciled and moved to Montana over 1.5 yrs. Ago. At times I strongly want to follow through with the initial divorce filing in state of Arizona. Things are not the same and I have great difficulty forgiving and forgetting. I continue to be haunted by the "affair." I believe one day a divorce is inevitable because he will want one due to boredom? We've were married in Montana 24 yrs. Ago. Can I still get a divorce in the state of Arizona where divorce papers were first drawn up but not filed and the lawywers office said they would be there when or if I ever needed them?

Jurisdiction is based on your residence which is Montana, not Arizona.

You need to file in Montana.

Agreed, you will now have to file in the state where you and your wife now live.

If you lived in Montana more than 6 months, then you have to file in Montana now. The papers in Arizona would only be good if you move back to Arizona and reestablish residence. You are now a resident of Montana.
