First you find the real dad if you can. If not then you get married and live together for at least one years time. Then search again for the father of the child. Go to court to get a dna test and make them the legal father. After that and if your situation is stable, you can ask the legal fathers permission. If he says no and wants a relationship with the child then your going to have to deal with it. If he agrees to the adoption then he will sign off on the child so your husband can adopt.

In summary, if you are living with this boyfriend, without marrying him, he doesn't qualify for a step-parent adoption. That is because he is not a step-parent yet, but rather simply someone your son's mother happens to be living with.

First, ANY question on law needs to include your general locale as laws vary by area. Most areas require that a couple be married to qualify for a step parent adoption. Almost all areas require that both bio parents agree to an adoption. So the court will require that you identify the possible fathers, and try to contact each of them to have a paternity test done. You will have to show a good faith effort to identify and find the father.
