Hi, I have a 5 year old that has my maiden last name.. I have since married and would like to change his last name to my new married name. I am trying to figure out how I petition this.. Since his (donor) has never been a part of his life,and really I have very little idea how to get a hold of him either. If it helps at all I live in WI. Thanks!

If you went to a sperm bank and had a real donor, then there is no bio father known. And of course you would have proof of this procedure to present to the court, So you make a petition for a name change, using the proof of the medical procedure as evidence that there is no known father.
If you have a real bio father who is just not in the child's life, you still need to get his permission for the name change, if he has not been proven the father in court, for reasons of custody, child support or more, you will normally have to request DNA test to prove paternity and then have them sign to allow the name change. Merely not being involved does not take away his rights
