First, its not a good idea to piggyback your question on someone else's thread, This can cause confusion, so I've moved your question to it's own thread.

What papers have been filed? Have any court orders been issued? What is your general locale?

Generally, if there is pending litigation or court orders issued, you can do nothing that will go against those orders without court approval. If you have simply filed for divorce, then you include the request to relocate as part of the petition. From there you can negotiate this. If there is court ordered visitation, then you have to go to court to modify the visitation.

That you already have a job offer in TX may help you in court. But you MUST get the court to approve the move. I would ask for an emergency hearing to get permission to move. Make sure you properly serve your husband for this hearing, because if he doesn't show you can get permission by default.
