How can my partner adopt my daughter. We have benn together for 4 years and my daughter is 4 years 6 months, we have a 1 year old son together, her biological father has never been in her life, how do we go about this?

There is a sticky in Family Law that describes this process. Usually you must be married to your partner for at least a year and have the permission of the biological father.

I'll request that this thread be moved to the Family Law board.

When you say "partner", are you talking about a same-sex partner?

If so, there are many states that do not allow same-sex unions to adopt.

In addition, nearly ALL states require that you be married for at least a year before a step-parent adoption can happen.

You also must seek permission from the biological father for an adoption to happen. Even if he is not involved in the child's life, he still has parental rights that must be relinquished for an adoption to go through.

Is her fathers name listed on the birth certificate?

In general without knowing more exact details,

If in the US, most states will require you to be married, you said partner but then said you and partner had a child together, so I will assume it is not same sex, if it is, that causes many more issues as to locations that allow

But you marry, be married for about a year, then hire an attorney who will contact the bio father and get him to sign his rights away to allow the adoption.

If you are pushing getting paid for child support, many non custody parents will be glad to sign to be able to stop paying support.
